1. General Information

These Terms and Conditions govern your attendance at the BSAC North West Dive Fest 2026 ("the Event") organised by BSAC North West Region. By purchasing a ticket and/or attending the Event, you agree to be bound by these terms.

Organisers: BSAC North West Region (via Staffordshire Divers and Southport BSAC)

2. Ticket Purchase & Registration

2.1 Ticket Prices

Advance Purchase (Online):

• Capernwray Members: £20
• Non-Capernwray Members: £5 entry + £23 day pass = £28 total

On-the-Gate (If Available):

• Capernwray Members: £25
• Non-Capernwray Members: £33

2.2 Ticket Validity

• Tickets are valid only for 28th August 2026
• Advance purchase tickets are subject to availability
• Tickets are limited – advance purchase is strongly recommended
• Tickets are non-transferable without prior written consent from the organisers
• Proof of purchase must be presented on arrival at the Event

2.3 Refunds & Cancellations

• Refund requests must be made in writing to info@nwdivefest.com
• Refunds are subject to our Cancellation Policy
• Processing fees may apply to refunded tickets
• The organisers reserve the right to cancel the Event due to circumstances beyond our control

3. Capernwray Membership Requirements

3.1 Membership Options

Option 1: Capernwray Annual Membership

• Join Capernwray as an annual member
• Best value if you plan to dive at Capernwray regularly
• Visit dive-site.co.uk/diving to join
• Event entry: £20 (advance) or £25 (on the gate)

Option 2: Day Pass (Non-Members)

• Purchase a Capernwray day pass for £23
• Then purchase Dive Fest entry for £5
• Total cost: £28 (advance) or £33 (on the gate)
• Day pass is valid for 28th August 2026 only

3.2 All Diving Agencies Welcome

• All divers are welcome, regardless of training agency
• BSAC, PADI, SSI, NAUI, and all other recognised agencies accepted
• Proof of certification must be presented before diving

3.3 Diving Insurance

• Third-party diving insurance is mandatory for all diving activities
• Proof of insurance must be presented at Capernwray reception
• Insurance is typically included with agency memberships
• Participants must comply with all safety requirements set by Capernwray Diving Centre

3.4 Medical Fitness

• Participants must be medically fit to dive
• Participants may be required to complete a medical declaration
• Diving under the influence of alcohol or drugs is strictly prohibited
• The buddy system must be observed at all times during diving activities

4. Event Activities

The North West Dive Fest 2026 includes the following activities:

• Underwater Photography Competition – Capture photos during the event and submit online for voting
• Underwater Treasure Hunt – Participate in a fun treasure hunt beneath the surface
• Scooter Sessions (DPV Try Dives) – Experience underwater scooters
• Rebreather Try Dives – Try diving with rebreather equipment
• Club Zone – Meet and mingle with divers from across the North West region
• Live DJ – Enjoy music and entertainment throughout the day
• Vendor Stalls – Browse diving equipment, services, and travel opportunities

All activities are subject to availability and may require additional sign-up. Some activities have specific prerequisites or certification requirements.

5. Photo Competition Rules

5.1 Eligibility

• Only photographs taken during the 28th August 2026 Dive Fest event are eligible
• Each participant may submit one entry
• Photos must be original work by the submitter
• All entries are subject to review before being published for voting
• Submissions must be made online through the official website

5.2 Rights & Usage

• By submitting a photo, you grant BSAC North West Region permission to display, promote, and share your entry
• Copyright remains with the photographer
• Entries may be used for promotional purposes related to future Dive Fest events
• The organisers reserve the right to remove any inappropriate content

5.3 Voting

• Each person may vote once per competition
• Voting manipulation or fraudulent activity will result in disqualification
• The organisers' decision is final

6. Health & Safety

• Participants attend the Event at their own risk
• All participants must comply with venue safety rules and instructions from Event staff
• First aid facilities will be available on site
• In case of emergency, contact Event staff or Capernwray personnel immediately
• Event hours: 10:00 AM – 5:00 PM on 28th August 2026
• All diving activities must be completed within venue operating hours

7. Behaviour & Conduct

• Participants must behave in a respectful and appropriate manner
• Harassment, discrimination, or abusive behaviour will not be tolerated
• The organisers reserve the right to remove any participant for inappropriate behaviour without refund
• Participants must follow all instructions from Event staff and venue personnel
• Smoking is only permitted in designated areas
• Alcohol consumption must be responsible; no diving under the influence

8. Photography & Video

• Photography and video recording may take place at the Event
• By attending, you consent to being photographed or filmed
• Images may be used for promotional purposes by the organisers and BSAC North West Region
• Commercial photography requires prior written permission
• Drone use is prohibited without prior written permission from venue and organisers

9. Intellectual Property

• All Event branding, logos, and content are protected by copyright
• Unauthorised use of Event materials is prohibited
• The "North West Dive Fest" name and logo are property of BSAC North West Region

10. Data Protection & Privacy

• Personal data is processed in accordance with UK GDPR

• We will not share your data with third parties without consent, except as required by law
• You have the right to request access to, correction of, or deletion of your personal data

11. Force Majeure

The organisers shall not be liable for failure to perform their obligations due to circumstances beyond reasonable control, including but not limited to:

• Acts of God, extreme weather conditions
• Government restrictions or regulations
• Public health emergencies
• Venue unavailability
• Transportation disruptions

In such circumstances, the organisers will endeavour to reschedule the Event or provide appropriate refunds as circumstances permit.

12. Limitation of Liability

To the fullest extent permitted by law, BSAC North West Region and the Event organisers shall not be liable for:

• Personal injury, loss, or damage to property
• Indirect or consequential losses
• Actions or omissions of third-party vendors, instructors, or service providers
• Loss or theft of personal belongings
• Diving accidents or incidents

Participants are strongly advised to arrange appropriate personal insurance. All diving is undertaken at the participant's own risk.

13. Changes to Terms

The organisers reserve the right to modify these Terms & Conditions at any time. Updated terms will be posted on this website. Continued participation in the Event following any changes constitutes acceptance of the revised terms.

14. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes arising from these terms or the Event shall be subject to the exclusive jurisdiction of the courts of England and Wales.
